1. Overview and Scope of Services

These Terms and Conditions govern all lead generation, publishing, digital media, writing, editing, proofreading, and marketing services offered across our multi-region network websites:

  • Australia, New Zealand & Oceania: ordwick.com.au
By accessing our websites, submitting lead capture forms, or engaging our commercial services, you (“Client“, “User“, or “You“) agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must discontinue use of our platforms and services immediately.

2. Intellectual Property & Copyrights

  • Full Ownership Transfer: Upon full settlement of all agreed fees, we assign and grant you complete intellectual property ownership of the final customized content and deliverables produced for your project. You are permitted to use, publish, or distribute the finished product as you see fit; we retain no proprietary rights over the final delivered material.
  • Pre-existing Material: You warrant that any text, data, images, or briefs provided by you to us do not infringe upon the intellectual property, copyright, or privacy rights of any third party.

3. Financial Terms, Payments, and Taxes

  • Advance Payment: For all customized digital services and lead generation packages, we require full upfront payment prior to project commencement, unless explicitly agreed otherwise in a signed master services agreement.
  • Taxes: All pricing excludes relevant local taxes (such as UK VAT or regional sales taxes) unless explicitly stated otherwise. The client is solely responsible for paying all applicable taxes associated with their purchase.

4. Revisions and Turnaround Times

To ensure client satisfaction, we offer structured revision cycles subject to the following framework:

  • Standard Revision Window: Numerous revisions are permitted within seven (7) days of initial project delivery. In exceptional circumstances, this period may be extended to 14 days upon written request.
  • Turnaround Turnstiles: Revision turnaround schedules vary by project urgency:

    • 24-Hour Urgency Projects: Revision turnaround is completed within 24 hours.
    • 24 to 48-Hour Projects: Revision turnaround is completed within 48 hours.
    • Standard Projects: Revision turnaround is completed within 72 hours.

5. Refund Policy

Because all services provided across ordwick.co.uk, ordwick.com, and ordwick.com.au are digital, customized, and initiated immediately upon order confirmation, refunds are governed by strict criteria:

  • Eligibility for Refunds: Refund requests are only valid if submitted before the submission of initial drafts/manuscripts or the commencement of active service work, whichever occurs first. Approved early-stage refunds are subject to an administrative and transactional deduction (equal to 10% of the total purchase amount or equivalent regional currency value).
  • Non-Refundable Circumstances: Once an order is processed and active work begins:

    • Refunds are not issued automatically.
    • Change-of-mind requests are strictly ineligible for refunds.
  • Final Approval: Once the client provides final sign-off or approval of the work, it constitutes full acceptance of the services rendered, and no refunds will be issued under any circumstances.

6. Cancellations and Chargeback Policy

  • Service Nature Acknowledgment: The client explicitly acknowledges that services begin immediately upon payment processing, including planning, drafting, layout design, or production.
  • Cancellations: Cancellations apply solely to future, unrendered services. Any work already completed, partially delivered, or revised is deemed fully rendered and non-refundable.
  • Dispute and Chargeback Waiver: Clients agree not to initiate a bank chargeback, payment reversal, or third-party dispute without first contacting business@ordwick.co.uk and allowing a reasonable window for professional resolution. Initiating an unauthorized chargeback after service commencement or delivery constitutes a material breach of these terms, empowering us to submit comprehensive fulfillment evidence directly to payment processors and issuing financial institutions.

7. Limitation of Liability and Indemnification

  • Disclaimer: Services and websites are provided on an “as-is” basis. We disclaim all implied warranties, certificates, or guarantees not expressly stated herein. We assume no liability for technical interruptions, system malfunctions, data loss, miscommunication, or unauthorized third-party misuse of submitted materials.
  • Indemnification: You agree to defend, indemnify, and hold Ordwick Media & Publications Limited, Media Spines LLC USA, and their regional subsidiaries harmless from any losses, claims, or liabilities arising from:

    1. Your use of our websites and services;
    2. Your breach of these Terms and Conditions; or
    3. Your infringement upon any third-party intellectual property, confidentiality, or privacy rights.

8. Governing Law and Jurisdiction

These Terms and Conditions, along with any separate commercial agreements, shall be governed by and construed in accordance with the laws of England and Wales, with cross-border operations aligned with applicable international trade frameworks. Any disputes shall be subject to the exclusive jurisdiction of the courts located in London, United Kingdom.
